- Contract -

Prior to the start of work, both parties (i.e. you & us) enter into a simple contract in regard to an agreement about what work is to be done & the legal aspects related to the scanning & the production of the DVD. This contract covers such things as copyright, our disclaimer, & your privacy (essentially it will be a summary of all the information on this page).

Please read our standard contract (download in Word format). By arranging to have work done you are indicating your agreement with the terms of the contract. It must be signed by both parties before any work begins. Both parties will get a signed copy of the contract. The purpose of the contract is to ensure that the legal rights & responsibilities of both parties are understood & agreed upon.

Permission is given for non-profit electronic viewing, via the Internet. Apart from this, & any use as permitted under the Act,

1. Copyright re music owned or available to you
Regardless of whether or how you purchased music, the copyright (i.e. the right to copy) usually remains with the person who made the music. For that reason we can not use music provided by you on the DVD unless:

  • you made it yourself & have copyright (we will require a certified copy of proof), or
  • you have purchased music & its copyright (we will require a certified copy of proof)

2. Copyright re music made by us & made available to you as part of your DVD
On the Samples page you will find a collection of music that we have made ourselves & hold the copyright. You can select to use that music as background music for your DVD. However the copyright is retained by us & you may only use the music for the purpose of background music for your DVD.

If you make copies of your DVD we do not consider that a breach of copyright.
If you record or isolate the music from the DVD slideshow that will constitute a breach of copyright.

3. Copyright re your personal data (i.e. your photos, etc)
Your photos are copyright to you. By agreeing to have them scanned you are giving us conditional copyright to copy them for the purpose of making a DVD for you. We will have your scanned images on our system only for as long as
it takes for the DVD to be produced & payment finalised.

Please note that if you fail to finalise payment for our services, you agree to transfer the ownership & copyright of your scanned images to us (which we will make available for sale to the public as part of our image library).

Additionally if we buy scanned images from you (e.g. for our image library) you agree to transfer the ownership & copyright of that image to us.

Image Quality & Reproduction

Please note that the quality & reproduction of images may be limited by their condition prior to scanning (e.g. dusty / dirty, damaged, etc). While a small amount of cleaning & digital image improvement is included with the scanning & processing any significant cleaning & digital image improvement will usually incur an additional cost (you will be advised at the time if any significant cleaning & digital image improvement is recommended).

Quality & Usability of Product Disclaimer / Product Testing

All DVDs / CDs are thoroughly tested before delivery to the customer to ensure they meet our high standards of product quality & usability. DVDs are tested on 2 independent TV / DVD player & PC systems (i.e. 4 systems). CDs are tested on 2 independent PC systems. It is important to state that quality & usability of the product may vary depending upon the operational state & quality of the customer's system (e.g. we can not guarantee that the product will work if the customer's DVD player is broken). For more information please read the 'Warranty' & 'Returns & Refunds' sections below.

'All care, no responsibility'

As much as possible Scan on the Run will exercise due care & diligence with the customer's property (including but not limited to; photos, albums, slides, negative, transparencies, & any other object temporarily in their possession) but does not accept any responsibility in regards to the condition of that property. This also applies to the customer's property at their location (i.e. on-site).

- Lawful compliance -

Scan on the Run respects & complies with the Law. If in the course of work Scan on the Run observes any breach of Law (including but not limited to; pornography, offensive acts, drugs, terrorism) they will be compelled to report it to the authorities. Please ensure that your photos do not contain images or information that represents a breach of Law. Please ensure that your location / premises do not breach the Law.

- Privacy -

We are committed to respecting & protecting personal privacy. Any personal information contained within this site is used on the understanding that its inclusion is within the provisions of The Privacy & Personal Information Protection Act 1998.

The purpose of this Act / law is to provide for the protection of personal information & for the protection of the privacy of individuals generally. Simply put 'privacy' is the ability of an individual to control their personal data. Personal information is information about an individual whose identity is apparent or can reasonably be ascertained. Personal information includes such things as paper files, electronic records, video recordings & photographs.

This site will be accessed via the Internet & is accessible to anyone with Internet access.

The information that you provide to us is for our internal purposes only, with the exception of when permission is given to make personal data public (this includes the contract provision relating to transfer of ownership in the case of non-payment -also see the Copyright section above).

Destruction of scanned images

Unless agreed otherwise, your scanned images will be stored for 1 week after payment has been finalised. After that they will be destroyed. (Please note on our Specials page the '$10 for 10 years*' backup offer.)

- Returns & Refunds -

Our refund policy: "Under the Trade Practices Act 1974 you may seek a refund if the goods:

  • are faulty through no fault of your own
  • are not fit for the purpose for which it was purchased
  • don’t match our agreed description

However, the goods must be returned within a reasonable period
(i.e. you must inform us within 1 week from the date of delivery & return the goods by Registered Post within 14 days from the date of delivery).

ou may be asked for proof of purchase.

You may also be asked to demonstrate that the problem with the goods was not your fault.

If you prefer an alternative to a refund, we can arrange for the goods to be exchanged
or a credit may be offered at our discretion.

Please choose carefully as you are not entitled to a refund if you simply change your mind!

Keep your receipt as proof of purchase".

Please note that you have 1 week (from the date of delivery) to notify us of a faulty DVD. Any damage or fault that occurs outside this time will be deemed as having been caused by you (your contract will stipulate these points).

If you choose the wrong type of media (e.g. DVD when you only have a CD drive, DVD-R when your DVD player can only play DVD+R) we can provide an extra copy of the DVD (in the format of your choice) at your expense.

You must bear the cost of the returns.

- Trademark -

Scan on the Run is a trademark, indicated by the symbol. The logo image (with 5 yin & yang's) is a trademark image for Scan on the Run, indicated by the™ symbol

- Warranty -

Due to the ease with which DVDs / CDs can be damaged through use & handling, our DVDs / CDs have a 1 week, 'return-to-base' (i.e. you are responsible for it return to us) limited replacement warranty (for more information see our 'Returns / Refunds' policy above). This means that it is in your interest to test the DVD / CD when you receive it & report any problems to us immediately. If you report a faulty DVD / CD to us within 1 week (from the date of delivery to you), you have to return it to us within 2 weeks (from the date of delivery to you).

If we test the DVD / CD & it is faulty we will send a replacement to you free of charge.
If we test the DVD / CD & it is not faulty we return it to you free of charge.

These warranty conditions will be part of your contract with us.

If you experience problems outside our 1 week warranty period we can provide an extra copy of the DVD at your expense.
